Terms of Service

1. Acceptance
By creating an account or using protectyourvibes.ai (the "Service"), you agree to these Terms of Service, the Privacy Policy, the Acceptable Use Policy, and (for deeper scans) the Terms of Engagement. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old, or 13 with verifiable parental consent. If you accept these Terms on behalf of an organization, you warrant that you are an authorized signatory for that organization.
3. Account
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify support@protectyourvibes.ai immediately if you suspect unauthorized access. One account per natural person.
4. The service
- PYV is a security scanning tool. We surface vulnerabilities and misconfigurations; we do not remediate them for you automatically.
- PYV is not a substitute for professional security testing, a penetration-test engagement, or a compliance certification (SOC 2, ISO 27001, HIPAA, PCI-DSS, etc.).
- We scan publicly accessible surfaces of web applications. See the Ethics policy and Terms of Engagement for tier definitions.
5. Acceptable use
Your use of the Service is governed by the Acceptable Use Policy. You explicitly may not:
- Scan sites you do not own or lack documented written authorization to scan
- Use the Service to attack, DoS, or extract data from third parties
- Circumvent our tier or ownership-verification gates
- Resell or sublicense the Service
- Scrape our data or reverse-engineer our scanner
6. Ownership verification
For owner-verified and premium-authorized scan tiers you warrant that you are authorized to test the target domain. See the Terms of Engagement.
7. Fees and billing
- Free tier — passive scans, no cost.
- Pro ($19.99/month or $99/year) — verified-ownership scans, monitoring, alerts, compliance reports, API access.
- Team / Enterprise — custom pricing and contract terms.
- Billing is handled by Stripe with your card on file. Subscriptions renew automatically until canceled.
- Cancel at any time via the Stripe Customer Portal from /settings.
- 14-day refund window on your first payment if unused. Later periods are not prorated for refunds. See the Refund Policy.
- Failed payments: 7-day grace period, then the account downgrades to the free tier.
- Plan changes: upgrades prorate immediately, downgrades take effect at the next billing period.
8. Free trial
We do not offer a time-limited free trial; we offer a genuine free tier. You can use the free tier indefinitely.
9. Intellectual property
- Your data is yours. You grant us a limited, non-exclusive license to process it only to operate the Service.
- Our code, scanner detections, and report templates remain ours. You may use the scan results we deliver for your own business purposes, including sharing them with your team or auditors.
- "Protect Your Vibes" and the PYV logo are trademarks of Protect Your Vibes Inc.
10. Feedback
If you send us feature suggestions, bug reports, or other feedback, you grant us a perpetual, royalty-free license to use them without obligation.
11. Third-party services
The Service relies on third parties (Stripe, Supabase, Vercel, Resend, Cloudflare, Sentry). Each has its own terms and privacy practices, which you should review. We are not responsible for third-party services we link to from the Service.
12. Warranty disclaimer
The Service is provided "AS IS" and "AS AVAILABLE". We do not warrant that the Service will find every vulnerability in a target application. Security scanning is inherently probabilistic: false positives and false negatives are possible. We disclaim all implied warranties to the maximum extent permitted by law.
13. Limitation of liability
Our aggregate liability to you for any claim arising out of or related to the Service is capped at the greater of (a) the fees you paid us in the twelve months preceding the event giving rise to the claim, and (b) one hundred US dollars ($100). We are not liable for indirect, incidental, special, consequential, or punitive damages. These limits do not apply to liability for fraud, gross negligence, or willful misconduct, or anything else that cannot be limited under applicable law.
14. Indemnification
You will indemnify and hold PYV harmless from any third-party claim arising out of your instruction to scan a domain you do not own or are not authorized to test. See the Terms of Engagement.
15. Termination
- By you — at any time via the Stripe Customer Portal or by deleting your account in /settings.
- By us— for material breach with 30 days' written notice, or immediately for scanning unauthorized targets, abusing the Service, or any violation of the Acceptable Use Policy.
- Survival — Sections 9 (IP), 12 (Warranty Disclaimer), 13 (Liability), 14 (Indemnification), and 16 (Disputes) survive termination.
16. Dispute resolution
- Governed by the laws of the State of Delaware (subject to update upon incorporation in another state), without regard to conflict-of-laws principles.
- Informal resolution first — email support@protectyourvibes.ai and allow 30 days before filing a formal claim.
- Binding arbitration — administered by JAMS under its Streamlined Arbitration Rules. Individual basis only; no class or representative actions.
- Arbitration opt-out — you may opt out of the arbitration clause within 30 days of first use by emailing support@protectyourvibes.ai.
17. Export and sanctions compliance
You may not use the Service from any country that is the subject of comprehensive OFAC sanctions, and you warrant that you are not on any US or EU restricted-party list.
18. Changes
We will email you at least 30 days before any material change to these Terms. Non-material edits (typos, link fixes) will be reflected by updating the "Last updated" date.
19. Entire agreement
These Terms, together with the Privacy Policy, Acceptable Use Policy, DPA, and (where applicable) the Terms of Engagement, constitute the entire agreement between you and PYV. If any provision is held unenforceable, the remainder continues in full force.
